DLSA Samba hosts online sensitisation prog for Police Officers, Prosecuting Officers & Executive Magistrates
Samba: District Legal Services Authority, Samba today organized an Online Sensitization Programme on the guidelines of the Supreme Court laid down in “Arnesh Kumar v. State of Bihar (2014) 8 SCC 273” for the Senior Police Officers, Prosecuting Officers and Executive Magistrates of the District Samba.
The event was held under the aegis of J&K Legal Services Authority, and under the supervision and guidance of Sonia Gupta, Chairman, District Legal Services Authority (Principal District & Sessions Judge), Samba.
The programme was aimed at to sensitize the participants about the “Guidelines of the Supreme Court laid down in Arnesh Kumar v. State of Bihar (2014) 8 SCC 273”; and recently on 07.05.2021 reiterated by the Supreme Court in Suo Moto Case titled ‘In Re Contagion of COVID Virus’ wherein the Court directed that authorities should not make arrest in violation of the guidelines laid down in the 2014 judgment in the case of Arnesh Kumar vs State of Bihar, which had held that arrests should be an exception in cases where the offences are punishable with less than 7 years imprisonment.
Arvind Sharma, Chief Judicial Magistrate, Samba (Chairman, Tehsil Legal Services Committee, Samba) was the resource person for the programme. He gave an overview about the provisions of arrest in the Code of Criminal Procedure and highlighted the Guidelines laid down in Arnesh Kumar’s case. He also elucidated the role of the Magistrate while authorising detention of an accused person.
Rajesh Sharma, SSP Samba; Javid Ahmad Khwaja, Public Prosecutor, Samba; Jaswant Raj, APP; Ravinder Verma, APP alongwith other police officers, SHOs and other officials of police and prosecution, Executive Magistrates, etc. attended the programme.
The proceedings of the programme were conducted by Slahuddin Ahmed, Sub Judge/Secretary, DLSA, Samba.
