University of São Paulo: Challenges for guaranteeing women’s rights

Rádio USP starts Women and Justice , a series that aims to bring up the problems, inequalities and multiple discrimination that have historically marked access to justice for women in the country and was born from the project Rewriting judicial decisions in feminist perspectives, coordinated by professor Fabiana Severi, from USP’s Ribeirão Preto Law School (FDRP).

The project brings together academics and jurists from different countries around the world who are working in a collaborative network and rewriting judicial decisions from a feminist perspective. In Brazil, they participate in the global Feminist Judgment Projects initiative, USP and 60 other Brazilian institutions. The idea, says Fabiana, is not to break with the original decisions, nor to evaluate the judgments and question the conditions that generated the original decision, but to reflect on whether different results and arguments are possible, within legal limits, and whether case resolutions can be different according to the interpretations of the judges. “The idea is to consider historical decisions, seeing if anything in that decision could be different when we apply a gender lens or feminist methodological approaches,” she clarifies.

For Professor Fabiana, transforming the project into a series brings visibility, in an unusual way, to the issue of gender equity and the challenges to guaranteeing women’s rights. “If we keep talking about women’s rights only when an episode happens, like that of the 11-year-old pregnant girl, the result of a rape, who went to court to have the right to an abortion and faced several obstacles, we don’t go deeper into the issue. knowledge about the most structural causes of the multiple and intersectional violence and discrimination against women in the country”.
